These Listing Terms & Seller Agreement (“Terms”) apply when you create, edit, or publish a listing on House Estate Sales. By checking the acceptance box on the listing form, you agree to these Terms.
1. Marketplace disclaimer
House Estate Sales and its operators provide an online venue only. We are not the buyer or the seller of items listed by third parties (except when we explicitly list an item as the seller ourselves). We do not take title to third-party listed goods in the ordinary course of operating the marketplace.
2. No responsibility for listings or outcomes
We are not responsible for any listing, item description, condition, title, safety, legality, authenticity, fitness for a particular purpose, or transaction outcome in any country, state, province, territory, or locality. You deal directly with the other party.
3. Seller and buyer legal duties
Sellers and buyers are solely responsible for knowing and following all applicable federal, state, provincial, and local laws where they live, where the item is located, and where the buyer is located. This includes export and import rules, firearms laws, vehicle and equipment title laws, consumer protection rules, and taxes.
4. Firearms and regulated items
Firearms and other items that require a Federal Firearms License (FFL) may be listed only through lawful FFL transfer processes as required by law. Sellers and buyers must know their local gun laws. House Estate Sales does not give legal advice. Illegal items are prohibited. You are responsible for completing any required FFL transfer correctly.
5. Vehicles and farm equipment
For vehicles and farm equipment, the seller is responsible for accurate VIN/serial information, title status, and disclosure of liens or defects they know about. The buyer is responsible for inspection and for following title-transfer and registration laws.
6. Listing fees
Listing fees are generally non-refundable once a listing is paid for and/or published, consistent with our pay-to-publish model. Fee-exempt accounts (if any) follow admin configuration.
7. Content standards
No fraud, stolen goods, counterfeit items, or other prohibited listings. We may remove listings, refuse service, or suspend accounts when we believe these Terms or the law may be violated.
8. Indemnity
As a seller, you agree to indemnify and hold harmless House Estate Sales and its affiliates, operators, and agents from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your listings, sales, descriptions, or failure to follow the law.
9. Local pickup
Fulfillment is currently local pickup. Buyers and sellers arrange meetup safely on their own. House Estate Sales is not a party to the meetup and is not responsible for personal safety or property damage at pickup.
10. Changes to these Terms
We may update these Terms from time to time. Continued listing or saving a listing after an update means you accept the current Terms. The version date above helps identify which Terms you accepted.
